Permissibility of projects during the preparation of the plan
(1) In areas for which a decision has been made to draw up a development plan, a project is permitted if
1.
the public and official participation pursuant to Section 3 (2), Section 4 (2) and Section 4a (2) to (4) has been carried out,
2.
It can be assumed that the project does not conflict with the future provisions of the development plan,
3.
the applicant acknowledges these provisions in writing for himself and his legal successors and
4.
the development is secured.
(2) In cases pursuant to Section 4a (3) sentence 1, a project may be approved prior to the renewed public and official participation if the amendment or supplement to the draft development plan does not affect the project and the requirements set out in paragraph 1 nos. 2 to 4 are met.
(3) 1If a procedure pursuant to § 13 or § 13a is carried out, a project may be approved before the public and official participation procedure is carried out if the requirements set out in subsection (1) nos. 2 to 4 are met. 2The public concerned and the affected authorities and other public interest bodies shall be given the opportunity to comment within a reasonable period of time before the permit is granted, unless they have already had the opportunity to do so.
